COVID-19 UPDATES: NOW BOOKING

As our top priority continues to be health and safety, we have added additional precautions at our sessions to mitigate risk for you and our makeup artist. Only one boudoir session is scheduled per day to allow us to fully clean and sanitize all furniture, bedding, props, and equipment before each session. In addition to our high studio sanitization standards, masks will be worn upon request for your personal comfort.

General Policies

The a-la-carte session fee pays for the time and talent of the photographer and for your in-person viewing appointment. It does not include any finished portraits. The full a-la-carte session fee is due upfront in order to secure a date on the calendar. Client understands that the final products will no be delivered until any balance is paid in full. Session retainers are non-refundable, and a $100 rescheduling fee will apply to any rescheduled sessions.

Pamela does not allow any men, partners, husband’s, boyfriends, etc. to attend boudoir photography sessions.

While Pamela Nicole does capture many images during your session, you will see only those images selected by her, the artist, for previewing. She carefully renders each image to ensure maximum artistry and technical excellence. Images that are not chosen by the photographer will not be shown and are removed from our archives permanently after the artist rendering is complete. The client will never see the Raw files.

You will view your portraits online through a private ordering gallery. You will have 48 hours to place an order.

  • Please allow 2 weeks for your order to be completed. Your portraits are an investment and an heirloom that should not be rushed. 

  • All ordered images are kept on file for a period of six months.

You agree to hold harmless, Pamela Nicole of Pamela Nicole Photography & Femme Art Boudoir, her representatives, and her employees, from any dispute in the event you become injured during your session or while on the studio premises. Femme Art Boudoir and its representatives will not be held liable for any injury to you, your children or your family members, or for any damage to your property during the photo session out on location or while on studio premises.

Your images will no be used for display or shared online or with anyone unless you express written permission by signing an online image release form.

Femme Art Boudoir is a female-only studio. Each photography session includes the female photographer, a single female client and a female makeup artist, if included. We do not provide services to couples or men.

Present during sessions

Partner’s Friends or Plus One's are not allowed in the studio during your session. Thank you for understanding; our studio is a private space.

IMAGE USE

Image prices reflect personal usage only. Images may not be used for commercial purposes or for monetary gain without expressed written permission from Pamela Nicole of Femme Art Boudoir. This includes but is not limited to self-promotion, websites, social media, Youtube, Only Fans, Advertisements, etc. Commercial usage of images will also require an additional fee. If images are used for monetary gain without the expressed written permission of the photographer you will be subjected to fines, penalties, and a suit for damages. 

THE PHOTOGRAPHER’S COPYRIGHT

The Copyright Act protects photographers by giving us the exclusive right to reproduce your photographs. Violations include, but are not limited to, making illegal copies, scanning, printing from home or downloading from our website. It is illegal to copy, edit, alter or reproduce these photographs in any manner without our permission and violators of this Federal Law will be subject to its civil and criminal penalties. Please understand, the photographer wishes to maintain complete control over the print quality, finishes and presentation of the images and any reproduction outside of the studio may lower the quality of the image and scar our reputation for providing superior portraits. {Copyright Law Title 17, Appendix V. LIMITATION OF LIABILITY

Although great care will be taken with these photography services and the digital photographs taken, the Photographer limits any liability for loss, injury, death, inability to perform the photography services for any reason, failure to deliver images for any reason or any other types of damages to the return of all payments already paid to the Photographer minus the expenses, up to the full amount will be returned to the customer.

INDEMNIFICATION

Client hereby agrees to indemnify, release, discharge and hold harmless the Photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority of the Photographer from and against any liability or claims arising as a result of any work done related to this agreement. This includes, but is not limited to claims related to the use of the likenesses of anyone captured in the images or any distortion, blurring or alteration that may occur or be produced in the taking, processing or reproduction of the photographs.

REFUNDS

All sales and payments are non-refundable.

ARTISTIC RIGHTS

The Photographer retains the right of discretion in selecting the photographic materials released to the client. The Client shall receive a gallery of at least 50 photographs to select from and shall not receive any photographic materials not presented to the Client. The Photographer also retains the right to make adjustments to the photographs in post-processing as the Photographer deems within their creative control.

USE OF ALCOHOL

The use of alcohol is permitted on the Photographer’s premises. The Client understands that consumption of alcohol prior to and/or during the session may negatively impact the results of the images.

USE OF INDEPENDENT CONTRACTOR

In the event a Photographer furnishes a hair and/or makeup artist, the Photographer is not liable for any application or services by this independent contractor. This includes but is not limited to allergies as a result of use of the products by the Independent Contractor. It is the Client’s responsibility to convey all allergies to the Independent Contractor.

RESCHEDULING

In the event that the Client requests to reschedule a photographic event, the retainer shall be applied to a rescheduled event if notice is given at least 2 days prior to the scheduled event. Reschedule must be within the same calendar year. Any cost for location usage will be paid for by Client. Photographer maintains the right to reschedule if needed due to inclement weather, illness, emergency, etc. at no additional costs to the Client.

SALES TAX

Sales tax for the city of Mesa will be added to all session fees and orders.

payment plans

Payment plans are simple - your full session fee needs to be paid on or before your session date (with 50% due at booking). Anything you order can be broken up into 6 months of payments with a 20% down payment due upon ordering. Your final product will be delivered when your balance is paid in full. Payments are non-refundable. Sales tax will be added to all orders and session fees.
